ARTICLE 1 - Scope

These General Conditions of Sale apply, without restriction or reservation to all sales concluded by the company BEOTERNUM MOROCCO, registered in the trade and companies register of Rabat under the number RC Rabat xxxx, and whose head office is located at: N ° 2, Avenue OKBA, imm 5 Angle ain Asserdoun & Azegza Agdal, Rabat – Morocco
(hereinafter referred to as the “Seller”) from non-professional buyers wishing to acquire the products offered for sale by the Seller on its website www.beoternum.com.
These conditions apply to the exclusion of all other conditions, and in particular those applicable to sales in stores or through other distribution and marketing channels.
These General Conditions of Sale are accessible at any time on this website and will prevail, where applicable, over any other version or any other contradictory document.
Unless proven otherwise, the data recorded by the BEOTERNUM MOROCCO Company constitutes proof of all transactions.
The products presented on this website are offered for sale according to the carriers for all the cities of Morocco.
Product offers are subject to the limits of available stocks. Information on product availability is provided at the time of ordering.
The modifications of these General Conditions of Sale are opposable to the users of the site as of their putting on line and cannot apply to the transactions concluded previously.
The validation of the order by the buyer implies unreserved acceptance of these General Conditions of Sale.

ARTICLE 2 - Orders

It is up to the Customer to select on the site the products he wishes to order, according to the following methods:

– By mail addressed to the “Commercial Department” at the following address: N ° 2, Avenue OKBA, imm 5 Angle ain Asserdoun & Azegza Agdal, Rabat – Morocco.
The sale will only be considered final after sending to the Buyer confirmation of acceptance of the order by the Seller by email and after final receipt by the latter of the full price of the order. .

ARTICLE 3 - Prices

The products are supplied at the current prices appearing on the site, when the order is registered by the Seller. The prices are expressed in Dirhams including tax.
These prices are firm and not revisable during their period of validity, as indicated on the Seller’s site. They do not include the costs of handling, shipping, transport and delivery, which are charged additionally.

3-1 Specific commands

Specific orders made by Professionals or because of their volume exceeding the sum of Twenty Thousand (20,000) Dirhams HT will be subject to a quote previously accepted by the Buyer. The quotes established by the Seller are valid for a period of ten (10) days from their date of establishment.
The order on estimate is considered accepted only after full payment of the total price of the amount of the order.
An invoice is established by the Seller and given to the Buyer upon delivery of the products ordered.

ARTICLE 4 - Payment terms

The price is payable in cash, in full on the day the order is placed by the Purchaser, by secure payment, according to the following terms:
– By credit card (Visa, Mastercard, CB),
– By PayPal,
The Seller shall not be required to proceed with the delivery of the products ordered by the Buyer if the latter does not pay him the full price under the conditions indicated above.
Payments by credit card are debited at the time of validation of the order.
Payments made by the Buyer will only be considered final after actual receipt of the sums due by the Seller.
In addition, the Seller reserves the right, in the event of non-compliance with the above payment conditions, to suspend or cancel the delivery of orders in progress made by the Buyer.

ARTICLE 5 - Deliveries

The products acquired by the Buyer will be delivered in Morocco to the following cities within a maximum period of thirty (15) days to the address indicated by the Buyer when ordering on the BEOTERNUM MOROCCO website. Except in special cases or unavailability of one or more products, the products ordered will be delivered in one go. The Seller undertakes to make its best efforts to deliver the products ordered by the Buyer within the deadlines specified above. However, these deadlines are communicated for information only and any overrun may not give rise to any damages, withholding or cancellation of the order by the Purchaser. However, if the products ordered have not been delivered within thirty (30) days after the indicative delivery date, for any reason other than force majeure, the sale may be canceled at the written request of the Buyer. or the Seller. The sums paid by the Purchaser will then be returned to him without delay, to the exclusion of any compensation or withholding. Delivery is deemed to have been made upon delivery of the products ordered by the Seller to the carrier who accepted them without reservation. The Buyer therefore acknowledges that it is the carrier’s responsibility to make the delivery and has no recourse in warranty against the Seller in the event of failure to deliver the goods transported. In the event of a specific request from the Purchaser concerning the conditions of packaging or transport of the products ordered, duly accepted in writing by the Seller, the related costs will be the subject of a specific additional invoicing, on prior estimate. accepted in writing by the Buyer. The Purchaser is required to check the condition of the products delivered. He has a period of 24 hours from delivery to form any reservations or complaints for non-conformity or apparent defect of the delivered products, by registered mail with acknowledgment of receipt, sent to the Seller with all the relevant supporting documents. After this deadline and failing to comply with these formalities, the products will be deemed to conform and free from any apparent defect and no complaint can be validly accepted by the Seller. The Seller will replace as soon as possible and at its expense, the delivered products whose apparent defects or lack of conformity have been duly proven by the Buyer. 

5-1 Costs, times and delivery methods

Checking the package: Upon receipt of the package, you must check the condition of it and its contents in the presence of the carrier before signing any delivery slip. By signing the delivery slip, the customer certifies that the items delivered are in perfect condition. If applicable, you must record your observations (missing product, broken product, damage, etc.) on the delivery slip. ARTICLE 6 - Transfer of ownership - Transfer of risks

ARTICLE 7 - Exchange

Damaged, soiled or incomplete items are not taken back.
The return costs will be the sole responsibility of the Buyer.
The return of the products must be accompanied by a return slip, available on the site, and the invoice.
The exchange (subject to availability) or reimbursement will be made within thirty (30) days of receipt by the Seller of the items returned by the Buyer.

ARTICLE 8 - Responsibility of the Seller - Guarantee

In order to assert his rights, the Buyer must, on pain of forfeiture of any action relating thereto, inform the Seller, in writing, of the existence of the defects within a maximum period of twenty-four (24) hours from count from their discovery.
The photographs and illustrations accompanying the products on the website have no contractual value and therefore do not engage the responsibility of the Seller.
The Purchaser is solely responsible for the choice of products, their conservation and their use.
The Seller will not be considered responsible or at fault for any delay or non-performance resulting from the occurrence of a case of force majeure usually recognized by Moroccan jurisprudence.

ARTICLE 9 - Data processing and Freedoms

The processing of information communicated through the Seller’s site has been declared to the CNIL.
The Buyer has, in accordance with the national and European regulations in force, a permanent right of access, modification, rectification and opposition with regard to information concerning him.

ARTICLE 10 - Intellectual property

ARTICLE 11- Applicable law - Language

These conditions are governed and subject to Moroccan law.
They are written in French. In the event that they are translated into one or more other languages, only the French text will prevail in the event of a dispute.

ARTICLE 12 - Disputes

All disputes to which these general conditions may give rise, concerning their validity, interpretation, execution, termination, consequences and consequences will be submitted to the competent courts under the conditions of common law.
In the event of a dispute with professionals and / or traders, the courts of Rabat will be competent.

ARTICLE 13 - Buyer's acceptance
